The Merced Police Department reported a fatal motorcycle accident on M Street on the afternoon of Monday, August 22, 2022. The collision took place around 4:30 p.m. at the intersection of West 25th Street and M Street, officials reported.
According to Merced PD, a man was driving a Nissan utility van eastbound on W. 25th Street. At the same time, a 58-year-old man from Merced was riding a motorcycle northbound on M Street. The Nissan driver allegedly entered the intersection in the direct path of the motorcyclist, authorities said.
The motorcycle rider allegedly laid the bike down and struck the Nissan, Merced PD reported. First responders arrived at the crash site to perform life-saving measures on the motorcyclist. He was transported to an area hospital for immediate treatment. Sadly, he was declared deceased at the hospital.
The identity of the deceased motorcycle rider has been withheld due to pending notification of next-of-kin. The Nissan driver was said to have stayed at the scene and cooperated with investigators. The incident remains under investigation by Merced PD.
Wrongful death is used to reference a loss of life that has occurred because of an incident caused by someone else’s negligence. No matter the cause, it generally results in unprecedented intangible losses and financial costs for surviving family members. If a family has lost a loved one in a motorcycle accident caused by a negligent driver, they may have the right to seek damages to compensate them for the harm they have endured. This may be accomplished by bringing a wrongful death action against the party responsible for the fatal motorcycle crash and their insurance carrier.
Some of the losses that may be recovered in a wrongful death case may include medical expenses, funeral costs, loss of the decedent’s expected wages, loss of support, mental anguish, and other damages. There are factors that may have an influence on these cases, such as the deceased’s age, education, income, health, degree of survivors’ dependence on them, and more. Aside from such losses, a Merced wrongful death attorney may be able to seek punitive damages if the other side’s actions were egregious. In the case of a fatal motorcycle accident, this may include DUI or excessive speeding.
Not all relatives can bring a wrongful death claim against a negligent party. Under the California Code of Civil Procedure Section 377.60, the right to bring such cases forward is limited to the surviving spouse, domestic partner, or children. If such relationships do not exist, other relatives may be eligible to bring a claim forward.
